Conflict of Interest & Self-Enrichment: Working for Two Competing Candidates at Once

We have described the activities of KDP Executive Board Members Tom Witt, Chris Reeves and Ryon Carey ("The Smoky Hill Gang") this week under the auspices of several sole proprietor entities. See herehere and here

The true ownership of sole proprietorships in Kansas is difficult to track. The revenues received and disbursements made by those entities are, likewise, difficult, if not impossible, to track short of subpoena. 

After reviewing combined GEC and FEC documents earlier this week, including tracking the addresses that were reported on those reports, we were able to produce a detailed analysis of where campaign finance dollars were sent for the Smoky Hill Gang and related sole proprietor and incorporated entities. 

Several questions were raised by readers of those posts. One question, however, is particularly troubling. 

When did KDP Executive Committee member Ryon Carey stop working for Dan Giroux and start working for Independent candidate Miranda Allen in the 2016 KS-04 Congressional Election?

It's a serious question, because evidence compiled from those joint campaign finance disclosures from the Kansas Government Ethics Commission (GEC) and Federal Election Commission (FEC) demonstrates that KDP Executive Committee member Ryon Carey continued to be a business partner at both Smoky Hills Strategies and BNV Printing along with KDP Executive Committee members Tom Witt and Chris Reeves both before and after his close corporation, Post Rock Partners, Inc., was formed on May 18, approximately two weeks following Miranda Allen's run for Congress

Additionally, those combined public disclosures suggest that KDP Executive Committee member Ryon Carey, likewise, worked simultaneously for both the Independent and Democratic candidates for Congress in the 2016 KS-04 general election. 

KDP Exec Board Member Ryon Carey's Post Rock Partners, Inc. Appears on Independent Miranda Allen's Reports for Congress in 2016

We provided substantiation on Monday that the Kansas Democratic Party attempted to subvert the 4th District Democratic Committee in the nomination process for the KS-04 Special Election.In that post, we provided substantiation that KDP Executive Committee member and Smoky Hills Strategies partner Ryon Carey was the 100% shareholder of a close corporation registered at the Kansas Secretary of State as Post Rock Partners, Inc. 

You'll recall our post from Wednesday that we identified Post Rock Partners, Inc. upon the FEC public disclosure (Page 22 of the 2016 Q3 Report). Upon searching the combined public disclosures files for the GEC and FEC, we discovered that Post Rock Partners, Inc. received a troubling, albeit nominal, sum from the Miranda Allen for Congress campaign on August 18, 2016. Miranda Allen ran for Congress against Dan Giroux as an Independent in the 2016 general election.

The Timeline Revealed by Public Disclosures

February 22, 2016 - BNV Printing Relationship Established with Giroux for Congress

The first evidence of a relationship between the Giroux for Congress campaign and entities and / or actors associated with the Smoky Hill Gang is roughly six months before the 2016 General Election, on February 22, 2016 (Page 25 of the FEC Q3 2016 Disclosure). That specific disbursement was to BNV Printing in Overland Park, Kansas. Since that time, the owners of the home at that address have repeatedly denied receiving any disbursements, though we cannot ascertain, if not them, who received those disbursements. 

In Wednesday's post, we published our findings from a one-year look-back on combined public disclosures to the GEC and FEC, which demonstrated that BNV Printing is a sole proprietorship that was reported on the combined public disclosures from both party and candidate committees in Kansas and had received disbursements from those committees at three (3) distinct addresses. Two of those addresses are used by KDP Executive Committee members Tom Witt and Ryon Carey in other public disclosures. 

February 26, 2016 - Smoky Hills Strategies Relationship Established with Giroux for Congress

The combined one-year look-back also establishes that Smoky Hills Strategies began a relationship with Giroux for Congress on or about February 26, 2016, when the first transaction between parties - Giroux for Congress and Smoky Hills Strategies - is reported on FEC public disclosures 

May 2, 2016 - Miranda Allen announces Congressional run as Independent

On May 2, 2016 Miranda Allen announced her intention to run for the KS-04 seat held, at that time, by Mike Pompeo. Dan Giroux and Robert Tillman were the Democratic nominees for the KS-04 Congressional seat. 

May 18, 2016 - Post Rock Partners, Inc. is Formed by Ryon Carey

According to the Kansas Secretary of State, KDP Executive Committee member Ryon Carey forms Post Rock Partners, Inc., a little more than two (2) weeks after Miranda Allen announces her intention to file as an Independent for Congress. 

July 16, 2016 - Smoky Hills Strategies Receives Disbursement from Giroux for Congress at Ryon Carey's Address

Public disclosures (Page 30 of the Giroux FEC Q3 2016 Disclosure) reveal that Smoky Hills Strategies receives a disbursement in the amount of $5,302.33 from Giroux for Congress campaign at Ryon Carey's address according to his voter registration. 

August 14, 2016 - Smoky Hills Strategies Receives Disbursement from Giroux for Congress at Ryon Carey's Address

Public disclosures again reveal (Page 30 of the Giroux FEC Q3 2016 Disclosure) reveal that Smoky Hills Strategies receives a disbursement in the amount of $5,000 from Giroux for Congress campaign to KDP Executive Committee member Ryon Carey's address.

August 18, 2016 - Post Rock Partners, Inc. Receives Disbursement from Allen for Congress at Ryon Carey's Address 

Post Rock Partners, Inc. appears on Miranda Allen's finance report (Page 22 of the Allen FEC Q3 2016 Disclosure). 

August 31, 2016 - Smoky Hills Strategies Receives Disbursement from Giroux for Congress at Ryon Carey's Address

Smoky Hills Strategies again receives a disbursement from the Giroux for Congress campaign in the amount of $1,780.57 (Page 51 of the Giroux FEC Q3 2016 Disclosure). 

Who Was Ryon Carey, a KDP Executive Board Member, Really Working For? 

The timeline obtained from the combined public disclosures suggests that KDP Executive Committee member Ryon Carey worked for two competing candidates for Congress simultaneously.
